National Employment Rights Authority ( N.E.R.A ) are now inspecting all employers in your area to ensure compliance with Employment Law Legislation if you are found to be non compliant fines can range from €1,900 to €15,000 for a breach of regulations increasing to €5000 fine or 2 years imprisonment ( summary offenses ) or €250,000 fine or 3 years imprisonment ( indictable offenses )

In general Inspectors have the following powers :
To enter any premises at a reasonable time , demand sight of records , inspect records , take copies of records , interview and require information from any relevant person including your staff .

Sample records which an inspector will require access to during the course of an inspection: -

  • Terms of employment for each employee / Payroll details / Copies of Pay Slips
  • Employees' job classification / Dates of commencement and where relevant, termination of employment
  • Hours of work for each employee (including starting and finishing times, meal breaks and rest periods)
  • Holidays and Public Holiday entitlements received by each employee and taken
